TERMS AND CONDITIONS OF SALE

These Terms and Conditions of Sale govern sales made on the TEKKAO website available at tekkao.com.

Hereinafter referred to as “TEKKAO” or the “Seller”.
2. PURPOSE AND SCOPE
These Terms and Conditions of Sale define the rights and obligations of TEKKAO and any individual acting for non-professional purposes, hereinafter referred to as the “Customer”, in connection with the distance sale of products offered on tekkao.com.
The Customer is invited to read these Terms and Conditions of Sale before placing any order.
Confirming an order implies acceptance of these Terms and Conditions of Sale in the version applicable on the date of the order.
3. PRODUCTS
The essential characteristics of the products are presented on the product pages of the website.
The Customer must review them before placing an order.
Photographs and illustrations are intended to present the products as faithfully as possible. Slight differences in presentation that do not affect the essential characteristics of the product may nevertheless exist.
Offers are valid subject to the stock and availability indicated.
4. PRICES
The applicable prices are those displayed on tekkao.com at the time of the order.
Prices are stated in euros.
Any delivery charges or other charges applicable to the order are shown to the Customer before final confirmation and payment of the order.
TEKKAO reserves the right to change its prices at any time. A price change does not apply to orders already confirmed.
5. ORDER
The Customer selects the products they wish to order and follows the different steps of the ordering process.
Before final confirmation, the Customer can review the details of their order, its total price and correct any errors.
The order becomes final after confirmation and payment.
An order confirmation is sent to the Customer at the email address provided when placing the order.
TEKKAO reserves the right to refuse or cancel an order in the event of proven fraud, attempted fraud, a payment incident or a legitimate reason provided for by applicable regulations.
6. PAYMENT
The available payment methods are those indicated during checkout on tekkao.com.
The Customer agrees to provide accurate payment information and to have the necessary authorization to use the chosen payment method.
The total amount of the order is shown before final confirmation.
Payment transactions are processed by the payment service providers offered on the store.
7. DELIVERY
Products are delivered to the destinations offered to the Customer during checkout.
The applicable delivery methods, charges and estimated delivery times are communicated to the Customer before the order is confirmed.
The Customer must provide a complete and accurate delivery address.
In the event of a delay or delivery difficulty, the Customer may contact TEKKAO at: contact@tekkao.com.
The legal provisions applicable to delays or failures to deliver remain fully applicable.
8. RECEIPT OF THE ORDER
Upon receipt of the order, the Customer is invited to check the condition of the products.
In the event of a damaged, incorrect or defective product, the Customer is invited to contact TEKKAO as soon as possible at contact@tekkao.com, providing information identifying the order and the issue encountered.
This provision does not limit the Customer’s rights under applicable legal guarantees.
9. RIGHT OF WITHDRAWAL
In accordance with the French Consumer Code (Code de la consommation), the Customer generally has fourteen (14) days from receipt of the goods to exercise their right of withdrawal, without having to justify their decision.
Where several goods forming part of the same order are delivered separately, the period begins upon receipt of the last item under the conditions provided by applicable regulations.
To exercise the right of withdrawal, the Customer must inform TEKKAO of their decision by means of an unambiguous statement or the standard withdrawal form provided at the end of these Terms and Conditions of Sale.

The Customer must then return the product in accordance with the instructions provided by TEKKAO and within the applicable statutory period.
Unless the law or TEKKAO provides otherwise, the direct return costs associated with exercising the right of withdrawal are borne by the Customer.
The Customer may be held liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and proper functioning of the product.
Any statutory exceptions to the right of withdrawal provided by the French Consumer Code remain applicable.
10. REFUND IN THE EVENT OF WITHDRAWAL
Where the right of withdrawal is validly exercised, TEKKAO refunds the amounts due in accordance with applicable legal provisions.
The refund is made no later than fourteen (14) days from the date on which TEKKAO is informed of the Customer’s decision to withdraw.
For the sale of goods, TEKKAO may defer the refund until the goods have been recovered or until the Customer provides proof of dispatch, whichever occurs first.
The refund is made using the same payment method used for the initial transaction, unless the Customer expressly agrees to another method and provided that this does not result in any fees for the Customer.
11. LEGAL GUARANTEES
Products sold by TEKKAO benefit from the applicable legal guarantees, including the legal guarantee of conformity and the guarantee against hidden defects, under the conditions provided by French law.
The legal guarantee of conformity allows the consumer to have the goods brought into conformity when the statutory conditions are met.
The consumer also benefits from the legal guarantee against hidden defects under Articles 1641 et seq. of the French Civil Code (Code civil).

TEKKAO will endeavor to process the request as quickly as possible.
13. LIABILITY
TEKKAO is responsible for the proper performance of its obligations in accordance with applicable regulations.
TEKKAO cannot, however, be held liable for a failure resulting from a force majeure event, an act attributable to the Customer, or an event attributable to a third party where the legal conditions for exemption from liability are met.
Nothing in these Terms and Conditions of Sale may exclude or limit any mandatory right granted to consumers by law.
14. PERSONAL DATA
Personal data collected in connection with orders is processed in accordance with the Privacy Policy available on tekkao.com.
The Customer is invited to review that policy for information about the processing of their data and the exercise of their rights.

16. GOVERNING LAW AND DISPUTES
These Terms and Conditions of Sale are governed by French law.
In the event of a dispute, the Customer retains all rights and remedies available under mandatory consumer protection rules.
Nothing in these Terms and Conditions of Sale deprives the consumer of any mandatory protective rules applicable to them.
17. CHANGES TO THE TERMS AND CONDITIONS OF SALE
TEKKAO may amend these Terms and Conditions of Sale, in particular to adapt them to changes in its business or applicable regulations.
The Terms and Conditions of Sale applicable to an order are those in force when that order is placed.
